Murray Divorce Lawyer

By Jill Coil, Founder and Family Law Attorney, Utah State Bar

Quick answer: Murray is in Salt Lake County, so your divorce is filed in the Third Judicial District Court. The Matheson Courthouse is the usual venue for Murray cases, a short trip north. You or your spouse must have lived in Utah and in Salt Lake County for at least three months before filing, Utah requires a 30-day waiting period before a decree can be entered, and with children under 18 both parents complete a divorce orientation class and a parenting class within 60 days.

Filing a Divorce in Murray

The Third District carries by far the busiest family docket in Utah, which affects timing more than procedure. Getting an early temporary orders hearing matters here, because the gap between filing and a contested final setting is longer than in the smaller districts.

  • Where it is heard. Murray is in Salt Lake County, which is the Third Judicial District. Family matters are heard at the Matheson Courthouse in downtown Salt Lake City and at the West Jordan Courthouse on Redwood Road; Murray cases usually go downtown, a short run up State Street or I-15. The Third District carries the busiest family docket in Utah, so what distinguishes it is scheduling rather than substance, and getting temporary orders in place early matters more here than in the smaller districts. Murray has two features that show up repeatedly in its cases. It is one of the few Utah cities that runs its own school district rather than sitting inside a county-wide one, so the district boundary is effectively the city line, and a parent moving to an adjoining city is proposing a change of school district even if the drive is five minutes. And with Intermountain Medical Center and the surrounding medical campus as the largest employer in the city, a substantial number of Murray parents work rotating twelve-hour shifts. A standard alternating-weekend schedule does not fit that pattern, and a workable Murray parenting plan is more often built around a published shift rotation than around a calendar week.

What Murray Cases Tend to Involve

Murray sits at the geographic centre of the valley and is dominated by healthcare employment, with Intermountain Medical Center and the surrounding clinics as the largest employers. Medical households bring specific issues: shift and call schedules that do not fit a standard possession order, physician and dentist practices that have to be valued as businesses, and the distinction Utah draws between the enterprise value of a practice and the personal goodwill attached to the individual professional.

What the Process Actually Looks Like in Murray

A Murray divorce moves at a pace set almost entirely outside the parties’ control: three statutory requirements, and the busiest court calendar in the state.

Nothing can be signed inside 30 days. Utah Code § 81-4-402 requires 30 days to pass between the filing of the petition and the earliest date a judge may sign a decree. The court can shorten it only on a written motion showing extraordinary circumstances. Check that number against any advice you have already been given. The wait was 90 days until May 2018, and the old figure survives on a great many websites.

One mediation session, at minimum, is compulsory. Where an answer raises something contested, Utah has required since 2005 that both spouses attend at least one mediation session and take part in good faith before a contested hearing can be held. A single session is all the statute demands, and a large proportion of cases never need a second. That requirement bends where safety is involved. If you would be unsafe in the room, or unable to speak plainly with your spouse present, the Divorce Mediation Program can excuse attendance for good cause. Apply for it rather than staying away unexplained.

Two classes for parents, on a 60-day clock. Each parent has 60 days from filing to complete a divorce orientation class and a parenting class, at a reduced fee if both are done within the first 30. A free online class exists separately for children aged 6 to 17. An unfinished class is among the most common reasons a decree is still unsigned weeks after the parties have agreed everything.

Where a Murray case is heard. Salt Lake County sits in the Third Judicial District, which hears family cases at the Matheson Courthouse in downtown Salt Lake City and at the West Jordan Courthouse on Redwood Road. The Matheson Courthouse is the more usual venue for east-side cases. The Third District carries the busiest family docket in Utah, which affects timing more than procedure: securing an early temporary orders hearing matters more here than in the smaller districts.

What We See in Murray Cases

Murray sits at the centre of the valley and is dominated by healthcare employment, with Intermountain Medical Center and the clinics around it as the largest employers. Medical households bring specific problems. Call and shift rotations do not fit a standard alternating-weekend order. Physician and dental practices have to be valued as businesses. And Utah draws a line between the commercial goodwill of a practice, which is divisible, and the personal goodwill attached to the individual practitioner, which generally is not.

The recurring fight in an owner-operated practice is how much of the profit is genuinely the owner’s compensation rather than a return on the business. That single figure moves in two directions at once: a higher salary number lowers the value of the practice but raises the income available for support. Expect it to be contested, and expect it to need a valuation professional rather than an accountant’s letter.

Frequently Asked Questions About Murray Divorces

Where is a Murray divorce heard?

In the Third Judicial District Court, which serves Salt Lake County from the Matheson Courthouse in downtown Salt Lake City and the West Jordan Courthouse on Redwood Road. The Matheson Courthouse is the usual venue for Murray cases, a short trip north.

How long do I have to live in Murray before filing?

Three months in Utah and three months in Salt Lake County. Where children under 18 are involved, they generally need to have lived in Utah for six months before a Utah court will make custody orders about them.

How long does a Salt Lake County divorce take?

Utah requires 30 days between filing and the entry of a decree, waivable only in extraordinary circumstances. An agreed divorce often finishes soon after. A contested case in the Third District commonly runs six months to well over a year, because it is the busiest family docket in the state.

Will a custody order keep our children in Murray School District?

Only if the order says so. Murray School District is unusually small, covering little more than the city itself, so a move to Taylorsville, Midvale or Holladay changes the district while still complying with a standard Salt Lake County restriction. If the schools matter, the district must be named.

Is property split fifty-fifty in Utah?

No. Utah is an equitable distribution state, so marital property is divided fairly rather than automatically equally. Courts weigh the length of the marriage, each spouse’s contributions and earning capacity, and the circumstances of the parties. Property owned before the marriage or received by gift or inheritance is generally separate if it has been kept separate.

How is a medical or dental practice valued?

Through a valuation professional who examines earnings, assets and comparable transactions. Utah distinguishes between the commercial goodwill of the practice, which is divisible, and the personal goodwill attached to the individual practitioner, which generally is not. A recurring dispute is how much of the profit is really the owner’s compensation, because that figure changes both the value of the practice and the support calculation.
