Midvale Divorce Lawyer

By Jill Coil, Founder and Family Law Attorney, Utah State Bar

Quick answer: Midvale is in Salt Lake County, so your divorce is filed in the Third Judicial District Court. Either courthouse serves Midvale, and the West Jordan Courthouse is often the shorter trip. You or your spouse must have lived in Utah and in Salt Lake County for at least three months before filing, Utah requires a 30-day waiting period before a decree can be entered, and with children under 18 both parents complete a divorce orientation class and a parenting class within 60 days.

Filing a Divorce in Midvale

The Third District carries by far the busiest family docket in Utah, which affects timing more than procedure. Getting an early temporary orders hearing matters here, because the gap between filing and a contested final setting is longer than in the smaller districts.

  • Where it is heard. Midvale is in Salt Lake County, so its cases belong to the Third Judicial District, which hears family matters at the Matheson Courthouse in downtown Salt Lake City and at the West Jordan Courthouse on Redwood Road. The Third District has Utah’s heaviest family caseload, which affects scheduling rather than the law applied, so an early request for temporary orders carries real weight. One Midvale point is worth knowing. The city runs from long-established neighbourhoods on the east to the newer Bingham Junction development on reclaimed industrial land to the west, and a larger share of households here rent than own. Where neither spouse holds a house, the property argument tends to be smaller and the parenting-schedule argument larger, because the parent who moves is the parent who changes the children’s school. Midvale schools sit in Canyons School District, and a move only a few miles west or south crosses into Granite or Jordan District territory, so a relocation that looks trivial on a map can still mean a new school.

What Midvale Cases Tend to Involve

Midvale has changed faster than most of the valley. Redevelopment around the Bingham Junction and Jordan Bluffs sites replaced industrial land with apartments and townhomes, and a large share of households now rent rather than own. That reshapes a divorce: where there is no house to divide, the fight is usually over the lease, the vehicles, retirement accounts and the parenting schedule, and it can be resolved considerably faster and cheaper than the valley average.

What the Process Actually Looks Like in Midvale

How long a Midvale divorce takes is decided mostly by three statutes and by the size of the Third District’s caseload, not by how much the parties disagree.

A 30-day wait applies to every case. Utah Code § 81-4-402 bars a judge from signing a decree until 30 days have passed since the petition was filed. Waiver takes a written motion and extraordinary circumstances, and it is the exception rather than the rule. Anything you read quoting 90 days is out of date. The period was shortened in May 2018, and a lot of published material was never corrected.

At least one mediation session is required. Utah has required since 2005 that where an answer raises a contested issue, both spouses participate in good faith in at least one mediation session before a contested hearing. It is a floor rather than a ceiling, and a good share of cases finish there. Where attending would be unsafe, or where you could not negotiate freely in the same room as your spouse, apply to the Divorce Mediation Program for a good-cause excusal. Simply not turning up is not the same thing and does not protect you.

Parents have two mandatory classes. Each parent must finish a divorce orientation class and a parenting class within 60 days of filing, and doing it inside the first 30 costs less. Children aged 6 to 17 can take a free online class of their own. Outstanding classes routinely hold up decrees in cases where everything else has already been agreed.

Where a Midvale case is heard. Salt Lake County sits in the Third Judicial District, which hears family cases at the Matheson Courthouse downtown and at the West Jordan Courthouse on Redwood Road. The West Jordan Courthouse is the closer of the two for the south-west valley. The Third District carries the busiest family docket in the state, so an early temporary orders hearing matters more here than elsewhere.

What We See in Midvale Cases

Midvale has changed faster than almost anywhere in the valley. Redevelopment of the Bingham Junction and Jordan Bluffs sites turned industrial land into apartments and townhomes, and a large share of households now rent rather than own. That reshapes a divorce completely: with no house to divide, cases turn on the lease, the vehicles, retirement accounts, debt and the parenting schedule.

Those cases are not lesser cases, but they are different ones. They resolve faster and cost less, because there is no appraisal and no buyout to negotiate. The risk is the opposite: debt. Where a couple has no equity to divide but carries credit-card and vehicle debt, the allocation of that debt is the whole case, and a decree that assigns a debt without addressing what happens if the assigned spouse defaults leaves the other exposed to the creditor regardless of what the order says.

Frequently Asked Questions About Midvale Divorces

Where is a Midvale divorce heard?

In the Third Judicial District Court, which serves Salt Lake County from the Matheson Courthouse in downtown Salt Lake City and the West Jordan Courthouse on Redwood Road. Either courthouse serves Midvale, and the West Jordan Courthouse is often the shorter trip.

How long do I have to live in Midvale before filing?

Three months in Utah and three months in Salt Lake County. Where children under 18 are involved, they generally need to have lived in Utah for six months before a Utah court will make custody orders about them.

How long does a Salt Lake County divorce take?

Utah requires 30 days between filing and the entry of a decree, waivable only in extraordinary circumstances. An agreed divorce often finishes soon after. A contested case in the Third District commonly runs six months to well over a year, because it is the busiest family docket in the state.

Will a custody order keep our children in Canyons School District?

Not automatically. Midvale is in Canyons, but Murray, Taylorsville and West Jordan next door are in three different districts. A standard restriction to Salt Lake County permits a move that changes the children’s school. If that matters, the district has to be named in the order.

Is property split fifty-fifty in Utah?

No. Utah is an equitable distribution state, so marital property is divided fairly rather than automatically equally. Courts weigh the length of the marriage, each spouse’s contributions and earning capacity, and the circumstances of the parties. Property owned before the marriage or received by gift or inheritance is generally separate if it has been kept separate.

What happens if we rent rather than own?

The lease is treated as a marital obligation, and the court can allocate who stays and who is responsible for the remaining term. Without a house to divide, cases usually turn on retirement accounts, vehicles, debt and the parenting schedule, and they tend to settle faster and cost less than cases involving property valuation.
