West Jordan Divorce Lawyer

By Jill Coil, Founder and Family Law Attorney, Utah State Bar

Quick answer: West Jordan is in Salt Lake County, so your divorce is filed in the Third Judicial District Court. The West Jordan Courthouse sits inside the city on Redwood Road, so most residents file and appear without leaving West Jordan. You or your spouse must have lived in Utah and in Salt Lake County for at least three months before filing, Utah requires a 30-day waiting period before a decree can be entered, and with children under 18 both parents complete a divorce orientation class and a parenting class within 60 days.

Filing a Divorce in West Jordan

The Third District carries by far the busiest family docket in Utah, which affects timing more than procedure. Getting an early temporary orders hearing matters here, because the gap between filing and a contested final setting is longer than in the smaller districts.

  • Where it is heard. Salt Lake County sits in the Third Judicial District, which hears family cases at the Matheson Courthouse in downtown Salt Lake City and at the West Jordan Courthouse on Redwood Road. The West Jordan Courthouse sits inside the city on Redwood Road, so most residents file and appear without leaving West Jordan.
  • Residency. You or your spouse must have lived in Utah, and in Salt Lake County, for at least three months before filing.
  • The waiting period. Utah requires 30 days between filing and the entry of a decree. A judge can waive it only in extraordinary circumstances.
  • Required classes. With children under 18, both parents complete a divorce orientation class and a parenting class within 60 days of filing.
  • How property is divided. Utah is an equitable distribution state, not a community property state, so marital property is divided fairly rather than automatically in half.

Custody and Schools in West Jordan

West Jordan is served by Jordan School District, shared with South Jordan, Riverton and Herriman. Jordan covers a large part of the south-west valley, so a move within that quadrant often keeps the children in the same district even when it crosses a city line.

What West Jordan Cases Tend to Involve

West Jordan is the largest of the south-west valley cities and among the largest in the state, with a housing mix that runs from 1970s subdivisions with real accumulated equity to newer developments carrying full mortgages. Which of those you are in changes the shape of the case entirely, so the first practical step is usually establishing what the home is actually worth against what is owed, before anyone commits to keeping it.

What the Process Actually Looks Like in West Jordan

The pace of a West Jordan divorce is set by three statutory requirements and by a court calendar that happens to sit inside the city limits.

Thirty days before a decree can be signed. Utah Code § 81-4-402 requires 30 days to elapse between the filing of the petition and the earliest signing of a decree. A written motion showing extraordinary circumstances can shorten it, and most cases do not qualify. If you have read that the wait is 90 days, that was true until May 2018 and has not been since.

At least one mediation session, in good faith. Where an answer raises a contested issue, Utah has required since 2005 that both spouses attend and participate in good faith in at least one mediation session before the case can be set for a contested hearing. One session is the statutory floor and it settles a great many cases. The requirement gives way to safety. Where a session would be unsafe, or where you could not negotiate honestly with your spouse present, the Divorce Mediation Program can grant a good-cause excusal, which is far better than an unexplained absence.

Two parenting-related classes, 60 days. Both parents must complete a divorce orientation class and a parenting class within 60 days of filing, with a reduced fee inside the first 30, and children aged 6 to 17 have a free online class. An outstanding class is one of the most common reasons an agreed decree is still waiting on a signature.

Where a West Jordan case is heard. West Jordan is unusual in that the Third District courthouse serving the south-west valley sits inside the city itself, on Redwood Road. For a West Jordan resident that removes most of the friction other litigants deal with. Filing, hearings, mediation orientation and the court’s self-help resources are all local, and a temporary orders hearing does not cost a day off work and a trip downtown. The court is still part of the Third Judicial District, so the law and the caseload pressure are the same as in Salt Lake City, and early temporary orders remain worth pursuing. Two things recur in West Jordan cases. The city’s children are in Jordan School District, which also covers South Jordan, Riverton, Herriman and Bluffdale, so a move within the south-west valley frequently keeps the school placement intact and takes much of the heat out of a relocation dispute. And West Jordan households are more often two-earner households with a mortgage and a retirement account than households with substantial liquid savings, which means the real negotiation is usually a trade: one spouse keeps the equity in the home, the other takes a larger share of the retirement. That trade only works if both sides are valued properly. Retirement money is generally pre-tax and home equity is not, so a dollar-for-dollar swap is rarely an even one.

What We See in West Jordan Cases

West Jordan is the largest of the south-west valley cities, and its housing runs the full range: 1970s subdivisions with real accumulated equity alongside newer developments carrying close to their full mortgage. Which of those you are in changes the entire shape of the case, so the first practical step is establishing what the house is actually worth against what is owed before anyone commits to keeping it.

The other thing worth knowing is that a courthouse inside the city cuts both ways. It makes attendance easy, but it also means the other party can file and serve quickly, and temporary orders can be in place before someone who has not taken advice understands what has happened. If you have been served, the response deadline runs regardless of whether you have found a lawyer yet.

Frequently Asked Questions About West Jordan Divorces

Where is a West Jordan divorce heard?

In the Third Judicial District Court, which serves Salt Lake County from the Matheson Courthouse in downtown Salt Lake City and the West Jordan Courthouse on Redwood Road. The West Jordan Courthouse sits inside the city on Redwood Road, so most residents file and appear without leaving West Jordan.

How long do I have to live in West Jordan before filing?

Three months in Utah and three months in Salt Lake County. Where children under 18 are involved, they generally need to have lived in Utah for six months before a Utah court will make custody orders about them.

How long does a Salt Lake County divorce take?

Utah requires 30 days between filing and the entry of a decree, waivable only in extraordinary circumstances. An agreed divorce often finishes soon after. A contested case in the Third District commonly runs six months to well over a year, because it is the busiest family docket in the state.

Do I have to go downtown for my hearing?

Usually not. The West Jordan Courthouse on Redwood Road is a Third District location inside the city, and Salt Lake County family cases are heard there as well as at the Matheson Courthouse downtown. For most West Jordan residents that means filing and appearing locally.

Is property split fifty-fifty in Utah?

No. Utah is an equitable distribution state, so marital property is divided fairly rather than automatically equally. Courts weigh the length of the marriage, each spouse’s contributions and earning capacity, and the circumstances of the parties. Property owned before the marriage or received by gift or inheritance is generally separate if it has been kept separate.

Will a custody order keep our children in Jordan School District?

Frequently, because Jordan School District covers West Jordan, South Jordan, Riverton and Herriman. A move within the south-west valley may well keep the same district. Naming the district in the order is still the safer approach if the schools matter.
